He woke up at 9 pm and starrted searching for his phone...we thought he placed it somewhere and he forgot, but 2 days ago he called it nd it was on after bieng "dead" for a couple of days...I looked on the myverizon site, and showed my daughters freind was to text to from his phone...all week since last saturday she has spend anight...so once my daughter and her freind went to the park I searched her backpack and found it....form the info off the internet she used about 50k info of internet (idk what that means)...it didnt charge anything because there is unlimited plan on it...
I didn't tell here I found out, but planning to tel my daughter tomarrow.
Can I sue, and should i if i can. How much do you tink i can sue for if i can?|||Sue for what? On what grounds? You must be an American.
You could have called the police to report a crime, but since you illegally opened her backpack the cops can arrest you too.
Leave it alone. Tell your daughter what happened and don't let the thief back in your house.|||Unless you can show that you (or your son) suffered in some tangible way (e.g. financially, experienced a loss because of a missed phone call, etc.) then you have no case.
I can understand why you'd want to make this girl pay, however. Perhaps the only real punishment you can dish out is to humiliate her by confronting her with it and telling her that she's not welcome in your home anymore. Personally, I wouldn't feel comfortable allowing a clepto like that in my house once I knew.|||Your daughter's friend committed an unlawful conversion. This is legal grounds for a lawsuit. You are entitled to recover any direct loss that the unlawful conversion caused you. That would be approximately $0. Legally, this one gets filed under "No harm, no foul."
By all means, however, confront your daughter's friend and let your daughter know. Don't allow this friend into your home any more.|||What do you plan to sue for? You have lost nothing in the way of damages. You said yourself, there is unlimited use on the cell phone so you have incurred no charges. Take possession of the phone and don't allow the little thief back in your home.|||Why is it people who want to sue for such petty things always have a new account, cannot spell and are unable to form an intelligent statement?|||You have absolutely no cause of action for a lawsuit.|||yah your not gonna make any money sueing|||You will probably lose more money paying the lawyer than u would win after suing|||Do you think that this problem should be a legal one? Lawyers are expensive and impersonal they aren't the solution for our problems as nice as it would seem to duke things out in court.
I think this quote makes me think twice before resorting to law:
"Policemen and laws can never replace customs, traditions and moral
values as a means for regulating human behavior. At best, the police
and criminal justice system are the last desperate line of defense for
a civilized society. Our increased reliance on laws to regulate
behavior is a measure of how uncivilized we’ve become." -Walter
Williams, “Laws Are a Poor Substitute for Common Decency, Moral
Values,” Deseret News, Apr. 29, 2009, A15
